Scott R. Belhorn

Overview

Scott R. Belhorn is Of Counsel in the Litigation and Creditor & Debtor Rights groups at McCarthy Lebit, focusing his practice on debtor-creditor issues, insolvency litigation, and complex financial transactions. His clients include businesses, creditors, receivers, bankruptcy trustees, and other stakeholders in receivership and bankruptcy cases. He is qualified to assist corporations to reorganize under Chapter 11 and also handles commercial litigation in federal and state courts. Scott has extensive experience analyzing financial records, managing complex litigation, and handling commercial fraud investigations. He advocates for his clients through all stages of discovery, settlement negotiations, trials, and appeals.

Drawing on nearly two decades of experience as a trial attorney and civil prosecutor with the U.S. Trustee Program, a component of the U.S. Department of Justice, he brings extensive courtroom experience and a deep understanding of complex financial matters to help clients navigate high-stakes disputes.

Since entering private practice, Scott has assisted receivers in securing appointments, helped victims of a Ponzi scheme recover millions of dollars of fraudulent transfers, settled claims by bankruptcy trustees, and supervised the marketing and sales of businesses and other commercial assets. His federal experience focused on representing the United States Trustee in Chapter 11 bankruptcies and conducting civil enforcement against individuals who defrauded their creditors and abused the bankruptcy process. He also pursued claims against major mortgage servicers following the 2009 financial crisis and represented the United States in federal habeas corpus proceedings involving military detainees held at the U.S. Naval Station at Guantanamo Bay, Cuba.

Scott served as a federal law clerk to the Honorable John S. Dalis of the United States Bankruptcy Court for the Southern District of Georgia. He entered the U.S. Department of Justice through the prestigious Attorney General’s Honors Program.

Scott attended The Ohio State University for his undergraduate studies, earning a Bachelor of Science degree. He earned his Juris Doctor at The Ohio State University Moritz College of Law.
