Overview

Mary K. Whitmer is Of Counsel in the Litigation and Creditor & Debtor Rights groups at McCarthy Lebit, where she focuses her practice on commercial litigation, bankruptcy, creditors' rights, receiverships, and business restructuring. A certified public accountant, Mary brings a distinctive combination of legal, financial, and business experience to complex insolvency matters, helping clients navigate challenging financial disputes with strategic, practical solutions.

With extensive experience in bankruptcy, receivership, and commercial litigation matters, Mary represents receivers and trustees, secured and unsecured creditors, creditors' committees, debtors, lenders, equity owners, and purchasers of distressed assets. Her practice encompasses fraudulent transfer litigation, preference recovery actions, successor liability disputes, lien priority matters, and commercial litigation arising from insolvency proceedings. She regularly guides clients through Chapter 7, Chapter 11, and Chapter 15 bankruptcy cases, as well as state and federal receiverships involving businesses across a broad range of industries.

From 2012 through 2018, Mary served as a Chapter 7 Panel Trustee for the United States Bankruptcy Court for the Northern District of Ohio, overseeing Chapter 7 bankruptcy cases.

She is actively involved in numerous professional organizations, including the Cleveland Metropolitan Bar Association, where she is a past president and a member of the Bankruptcy and Commercial Law Section; the Cleveland Metropolitan Bar Foundation, where she previously served as president and treasurer; the Commercial Law League of America, where she is a past president and member of the Bankruptcy Section; and the Ohio Society of Certified Public Accountants.

Mary earned her Juris Doctor from Case Western Reserve University School of Law after receiving her bachelor's degree from Case Western Reserve University. She is recognized by The Best Lawyers in America® and Ohio Super Lawyers® for her distinguished work in bankruptcy, creditors' rights, and commercial litigation.
