Overview
Charles A. Nemer is Co-Managing Principal at McCarthy Lebit. His legal practice focuses on municipal law, zoning and land use, commercial real estate transactions, real estate litigation, title insurance defense, receiverships, commercial foreclosures, business transactions, and liquor law matters throughout Cleveland and Northeast Ohio. He is recognized by Ohio Super Lawyers® and The Best Lawyers in America® for his work in these practice areas.
He represents a broad range of clients including property owners, developers, lenders, businesses, and title insurance companies in complex real estate, development, and commercial disputes across Ohio. His municipal law and land use practice includes advising clients on zoning compliance, variance and conditional use applications, permit approvals, and appeals of decisions issued by municipal bodies, planning commissions, zoning boards, and city councils. He is regularly engaged in matters involving real estate development strategy and navigating local regulatory approval processes for both private and public entities.
In his commercial real estate practice, Charles advises clients on acquisitions, financing, leasing, development, and workouts involving distressed and performing assets. He routinely negotiates and drafts purchase and sale agreements, commercial leases, loan documents, easements, options, rights of first refusal, and organizational and governance documents for business and real estate entities. He also assists borrowers in structuring loan resolutions including forbearance agreements, loan modifications, discounted payoffs, deeds in lieu of foreclosure, loan assumptions, and other alternatives to foreclosure, as well as handling lender liability disputes.
Charles has significant experience in commercial foreclosure and receivership matters, representing lenders, court-appointed receivers, and private parties in cases involving distressed real estate, asset preservation, and creditor remedies.
He also maintains an active real estate litigation and title insurance defense practice, drawing on prior experience serving the title insurance industry as general counsel for a title agency and as claims counsel for a title insurer. In this capacity, he has handled a wide range of matters involving title defects, coverage disputes, boundary and easement issues, and commercial property litigation.
In addition, Charles advises businesses and hospitality clients on Ohio liquor law matters, including licensing, regulatory compliance, permit transfers, and administrative proceedings before state and local authorities.
Beyond his private practice, Charles has held several public service roles, including appointment to the Ohio Lottery Commission by Governor Bob Taft, where he later served as Vice-Chair following his reappointment. He currently serves as Magistrate for the Village of Newburgh Heights as well as Magistrate and Acting Judge in Bedford Municipal Court.
